Montana judge blocks short-term ban of flavored marijuana vapes, e-cigarettes

A judge in Montana halted a short-term ban on flavored vaping merchandise, such as health-related cannabis, which was scheduled to go into impact Oct. 22.

Ravalli County District Judge Jennifer Lint signed a short-term restraining order Friday that prohibits Gov. Steve Bullock and state well being officials from enforcing emergency guidelines on flavored vaping merchandise.

Lint was acting in response to a lawsuit filed by 3 vape shops and an e-cigarette business group.

The suit claims the 120-day ban is an overly restrictive reaction to a national outbreak of vaping-associated illnesses and deaths they say is brought on by black-industry merchandise.

The company owners mentioned the pulmonary illnesses could be the outcome of the “illicit addition” of THC or marijuana merchandise into legal vaping merchandise. THC and marijuana are not incorporated as components in any of the merchandise sold by the corporations involved in the lawsuit, according to the plaintiffs.
